Terms of Service

By accessing or using the HexaFloww platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all administrators, users, and anyone else who accesses the Service.

HexaFloww is a B2B marketing platform providing email campaign management, WhatsApp broadcasting, social media inbox management (Facebook, Instagram), audience segmentation, marketing automation, and AI-assisted tools. The Service is intended for use by businesses to communicate with their own customers and prospects.

You must be at least 18 years old and authorised to act on behalf of your organisation to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at jigar@hexagn.in if you suspect unauthorised access.

You agree to use the Service only for lawful purposes. You must not:

• Send unsolicited bulk messages (spam) or contact individuals without their consent
• Upload or transmit malware, viruses, or harmful code
• Violate any applicable law, including anti-spam regulations (CAN-SPAM, GDPR, DPDP Act, etc.)
• Impersonate any person or entity
• Harvest or scrape data from the platform beyond your own account's data
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to promote illegal activities, hate speech, or harmful content
• Resell or sublicense access to the Service without prior written consent
• Violate Meta Platform Policies when using Facebook or Instagram integrations

You retain ownership of all marketing contact data, message content, and other materials you upload to the platform ("Your Content"). You grant us a limited, non-exclusive licence to process Your Content solely to provide the Service.

You represent and warrant that you have the legal right to process and communicate with all contacts in your database and that doing so complies with applicable data protection laws.

The Service integrates with third-party platforms including Meta (Facebook/Instagram), WhatsApp, AWS SES, and AI providers. Your use of these integrations is also subject to each provider's terms and policies. We are not responsible for any changes, outages, or policy updates from these third parties that affect the Service.

All software, interfaces, logos, and documentation comprising the HexaFloww platform are the intellectual property of HexaFloww and its licensors. Nothing in these Terms grants you any right to use our trademarks, trade names, or logos without prior written permission.

If your access to the Service is subject to a paid plan, payment terms are governed by your separate agreement with us. Failure to pay may result in suspension or termination of your account. All fees are non-refundable unless otherwise stated in your agreement.

Either party may terminate the relationship at any time. We reserve the right to suspend or terminate your account immediately, without notice, if you violate these Terms or applicable law. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our data retention policy.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXAFLOWW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the fees paid by you to us in the three months preceding the claim.

You agree to indemnify and hold harmless HexaFloww and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or any applicable law.

We may modify these Terms at any time. We will notify registered administrators by email of material changes at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
